定金的性质可以由当事人约定。当事人可以在合同中约定定金具有互不排斥的多重性质。例如，对立约定金，当事人可以约定在正式订立主合同后，定金不予以返还，而是转而用作违约定金；对于成约定金、证约定金，亦可通过约定使其给付后同时具有违约定金性质。

no matter表示“无论这样”，相当于regardless of的意思。

earnest money表示“保证金，预付金”，有点类似与deposit。

客户希望交货后付款，但是考虑到材料的支付费用和供货方的资金周转，双方同意预付50％的货款。

A：If it's OK with you, we would like payment prior to delivery, since this is your first order.

B：I understand why you like that way. We prefer payment after delivery, because these goods are highway robbery.

A：I know they are very expensive, but why does that mean you should pay after delivery?

B：It's a large order. If we give you advance payment, we'll get many troubles. It will take three or four months to sell the goods and start to make a profit.

A：I understand. But we must pay the suppliers for the materials in advance, and if we wait three or four months to get paid, we'll have a lot of troubles too.

B：Let's do it this way. We'll pay 30％ deposit of the invoice value by T/T, and then pay the rest of the amount by T/T after shipment is arrived.

A：Well, T/T 30％ deposit is a usual terms. However, just as you mentioned, it's a big order, we need more money to run the business. As you see, we have only moderate means at hand and the tie-up of funds for as long as three to four months indeed presents a problem to us.

B：OK, let's raise the deposit to 50％ of the invoice value.

A：如果可以的话，我们想让你们在交货之前付款，因为这是您们第一份订单。

A：电汇30％的预付款是老规矩了。但像您所说的，这是一大笔订单，我们需要更多的钱才能周转。您知道我们手头资金有限，占压资金长达三四个月对我们来说是个问题。

B：好吧，那我们把预付款提高到发票金额的50％。

highway robbery价格昂贵

highway robbery的字面意思是“公路上的抢劫”。大家想想，在公路上被抢劫，前不着村，后不着店的，稍不小心，得罪了歹徒，就很可能会命丧黄泉。所以被抢的人当要拿出所有的钱来才有可能保住性命了。因此highway robbery后来引申为“价格昂贵”，常被用来形容词。例如：That's high way robbery.（简直是天价啊。）
